New marking obligations for packaging in Spain and possibility to show recycling fees on invoices

The new Spanish packaging law – Royal Decree 1055/2022 – contains new marking obligations for household packaging from January 2025 on. It also allows companies to show the corresponding packaging fess on invoices voluntarily.

Royal decree 1055/2022 not only implemented a new packaging registry and AR duties for foreign companies with a NIF. It also introduces marking obligations comparable to Italy, France and Bulgaria.

From January 2025 on it will be mandatory to mark every packaging (material) and container in which products for Spanish households are sold/shipped/packed. Business/professional products and their packaging are not applicable. A separate labeling is required according to the type of container whereas Spain distinguishes between 4 types of them:

  • Yellow (Amarillo) for plastic, metal and drink carton packaging
  • Blue (Azul) for paper and cardboard packaging
  • Brown (Marrón) for Compostable packaging
  • Green (Verde) for glass packaging

This labeling can be done by direct printing on the packaging material or via stickers.

Compostable plastic shall be marked as per standard UNE EN 13432:2001.

Under the new decree it is prohibited to use expressions or wordings such as “ environmentally friendly” or equivalents that may result in littering.

It is also possible to show the recycling fees for packaging separately on invoices. Although it is mandatory to do so there are certain requirements if you do so.
