Last week the battery take back scheme Ecobatterien informed about new requirements in Luxembourg. In the context of Regulation (EU) 2023/1542 of the European Parliament and of the Council of 12 July 2023 concerning batteries and waste batteries, amending Directive 2008/98/EC and Regulation (EU) 2019/1020, and repealing Directive 2006/66/EC, new requirements will apply to producers as of 18 August 2025 regarding the provision of information on battery waste prevention and management, as well as on the costs covered by producers.
As a reminder, the concept of “producer” within the meaning of this regulation, Article 3(1), point 47, includes manufacturers,importers, distributors, or any other natural or legal person who places batteries on the market, regardless of the selling technique used, including through distance contracts.
It should also be noted that, in accordance with this regulation, the term “batteries” replaces the terms “batteries and accumulators”previously used, and now covers all battery types.
Pursuant to Article 74(1) of the regulation, producers shall ensure that end-users and distributors (final sellers) are provided with information related to the prevention and management of waste batteries.This information must be made visible at least at the point of sale as well as on online platforms, and must include in particular:
– Best practices for extending battery life and enabling reuse, repurposing, and remanufacturing;
– The role of end-users in the separate collection of waste batteries;
– Collection and take-back points, as well as operations related to preparation for reuse, repurposing,
and treatment of waste batteries;
– Safety instructions for the handling of waste batteries (particularly those containing lithium);
– The meaning of labels and symbols appearing on batteries;
– The environmental and health impact of hazardous substances contained in batteries, as well as the risks linked to inappropriate disposal.
Furthermore, Article 74(5) provides that producers shall separately communicate to the end-user, at the point of sale of a new battery, the costs they cover, including, among others, those related to the collection and treatment of waste batteries, as well as reporting to the competent authorities, through the recycling and administrative fees paid to Ecobatterien.
