As highlighted in our newsletters from July and October, several relevant changes for battteries nand packaging have been implemented in Denmark.
EPR Batteries in Denmark
In connection with the implementation of the EU Battery Regulation (EU-BattVO), foreign companies are now required or have the option to register for the EPR category “Batteries” in Denmark. Registration takes place via an appointed authorised representative for batteries.
All obligated companies must register in Denmark for all types of batteries in accordance with the requirements of the new EU Battery Regulation. For companies that already hold a WEEE registration in Denmark, it is expected that the battery registration can be carried out within the same general framework.
These new provisions apply as of 2025, as the regulation entered into force in mid-August.
Manufacturers selling products directly to end users in Denmark are generally required to register, based on the currently available information. Companies supplying exclusively to Danish importers, distributors or resellers may register voluntarily and report the relevant quantities.
Our clients have already been comprehensively informed, and we will implement the corresponding adjustments.
EPR B2B Transport Packaging in Denmark
According to the information currently available, the implementation of the new EPR requirements for packaging in Denmark introduces several important changes, particularly affecting foreign manufacturers and companies. Companies supplying packaged products to Danish B2B importers, distributors or resellers are, according to the current interpretation, independently responsible for the registration and reporting of their B2B transport packaging. This responsibility does not lie with the Danish B2B recipient—unlike in many other EU countries.
Danish companies, on the other hand, are only responsible for B2C product packaging, meaning sales packaging that is supplied to end consumers in Denmark.
Based on the current understanding, the following structure applies:
- Foreign companies selling products directly to end consumers in Denmark (e.g., via an online shop) are required to register for B2C sales packaging and also for their shipping packaging, which is classified as B2C packaging since it arises at the end consumer.
- Foreign companies placing products on the Danish market via importers, distributors or resellers are responsible for the registration and reporting of their B2B transport packaging. These companies may also voluntarily register and report their B2C sales packaging.
