“Ecomodulated” fees for packaging in Denmark / EPR producer responsibility in Denmark

Alongside the new packaging legislation in Denmark the biggest take back scheme Emballageretur announced a bonus system for packaging fees and clarifies the obligations for foreign companies and distance sellers.

Producers and distributors that are located outside Denmark may have producer responsibility in Denmark for packaging – depending on how they sell. All types of packaging are covered by the new legislation – meaning sales packaging as well as commercial and transport packaging.

Emballageretur clarifies that if you sell packaged products directly to an end-user (a consumer or a business) you have producer responsibility for the packaging that becomes waste at the same location as the buyer, e.g. if the buyer unpacks the product.

If your customer resells the products in the original packaging then you are not responsible for that packaging.

Emballageretur also published their revised fees and offered the application for so-called yellow and green level ecomodulated fees which contain financial benefits (lower prices) compared to the standard “red level” fees on their price list.
