The German Packaging law (VerpackG) is the implementation of the EU Packaging Directive 94/62/EC in Germany. Take-back and recycling obligations for packaging
Do you sell packed products within the EU or even worldwide? Then you have various take back and recycling obligations in numerous countries all over the world for the packaging material.
Due to the so called extended producer responsibility (also called “polluter-pays-principle”) your company is liable for all kinds of distributed packaging – including sales-, service-, and transport-packaging. That means every producer, distributor and seller has to ensure appropriate national take-back and recycling possibilities and has to follow certain legal obligations. These liabilities may be fulfilled by joining national take-back schemes and by registering with national authorities.
This also makes sense in terms of sustainability aspects as used packaging material can be recycled and may be used as secondary raw-material again.
That was the idea behind the European packaging directive 94/62/EC which has been adopted individually in all EU countries and many non-EU countries as well: to implement the producer-pays-principle in the field of packaging recycling.
While there are many national adoptions and versions of packaging laws there is no single registration entity for Europe which means that every company has to deal with every single regulation in each country on their own. At the end of the day this results in high administration efforts and high costs.
